6th Avenue Shooting Ruled a Homicide

TPD has arrested Herbert W. Newby, Jr. in connection with the shooting which occurred at the intersection of 6th Avenue and Old Bainbridge Road on November 11, 2019 at approximately 6:08 p.m. The investigation revealed that Newby and the victim were in a verbal altercation over street level narcotics sales several days prior to the shooting. Violent Crimes Investigators developed probable cause to charge Newby with 2nd Degree Murder and Possession of a Firearm by a Florida Convicted Felon. After consultation with the State Attorney’s Office, investigators secured warrants for Newby's arrest.
Newby was taken into custody by TPD's Career Criminal Unit and transported to TPD for questioning. A search of the residence on Shelfer Road where Newby was staying, resulted in Tallahassee Police officers recovering a 9mm handgun which was previously reported stolen out of Jefferson County, Florida. Also located were various types of gun ammunition, several small baggies of what is believed to be synthetic marijuana or spice, Alpha-PVP and drug paraphernalia. Newby was transported to the Leon County Detention Facility for processing. Additional firearms and drug related charges were added during the booking process. - 2nd Degree Murder pursuant to Florida Statute 782.04(2).
- Possession of a Firearm by a Florida Convicted Felon pursuant to Florida Statute 790.23(1)(a).
- Possession of Weapon or Ammunition by a Florida Convicted Felon pursuant to Florida Statute 790.23(1)(a).
- Grand Theft of a Firearm pursuant to Florida Statute 812.014(2)(c)5.
- Possession of a Controlled Substance without a Prescription pursuant to Florida Statute 893.13(6)(a).
- Possession of Drug Paraphernalia pursuant to Florida Statute 893.147(1).

Original Release
At approximately 6:08 pm TPD responded to a shooting near the intersection of 6th Avenue and Old Bainbridge Road. Upon arrival, officers located one victim suffering from a gunshot wound in the roadway. That victim was taken to a local hospital with serious injuries.
